TERMS & CONDITIONS

Effective Date: September 1, 2026

Welcome to The Nourished Village™, a membership community created by Nourished Village Nutrition LLC (“Nourished Village Nutrition,” “we,” “us,” or “our”).

​

These Terms & Conditions (“Terms”) govern your purchase of and participation in The Nourished Village (“Membership”).

By purchasing the Membership, checking the box agreeing to these Terms at checkout, or accessing or participating in the Membership, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you should not purchase or access the Membership.

1. THE NOURISHED VILLAGE MEMBERSHIP

The Nourished Village is an educational membership designed to support parents and caregivers of children experiencing picky eating, extreme picky eating, food anxiety, and related feeding challenges.

Depending on the Membership plan and offerings available at the time of purchase, Membership may include:

• Access to courses and educational content

• Q&A opportunities

• Bi-monthly parent group coaching calls

• Monthly challenges

• Community discussions and support

• Replays of eligible live calls

• Worksheets, guides, activities, and other downloadable resources

We reserve the right to add, modify, replace, or discontinue content, resources, challenges, calls, schedules, or other Membership features as we continue to develop and improve the Village.

The Membership does not guarantee access to any particular course, resource, call, challenge, or feature indefinitely.

2. EDUCATIONAL PURPOSE & PROFESSIONAL DISCLAIMER

The Nourished Village provides education, general feeding guidance, coaching, and community support.

The information provided through the Membership is intended for educational and informational purposes and is not intended to replace individualized medical, nutritional, psychological, occupational therapy, speech therapy, or other healthcare services.

Sarah Derry is a Pediatric Registered Dietitian/Nutritionist. The Nourished Village does not provide occupational therapy, speech therapy, psychology, psychotherapy, or other services outside of the scope of practice of a Registered Dietitian/Nutritionist.

No professional-client relationship is created between you and Nourished Village Nutrition LLC solely through your purchase or participation in the Membership.

You are responsible for determining whether information or strategies provided through the Membership are appropriate for your child.

If your child has medical, nutritional, developmental, swallowing, behavioral, psychological, or other concerns that require individualized assessment or treatment, you should seek care from an appropriately qualified healthcare professional.

The Nourished Village does not provide emergency medical or feeding services.

If you believe your child is experiencing a medical or feeding emergency, seek appropriate medical care immediately.

3. ARFID, PEDIATRIC FEEDING DISORDER & COMPLEX FEEDING NEEDS

The Nourished Village may address complex feeding concerns, including but not limited to:

• Extreme food restriction

• Food anxiety

• Fear of new foods

• Sensory challenges

• Rigidity

• ARFID

• Pediatric Feeding Disorder

• Dropped foods

• Limited food variety

• Mealtime challenges

The Membership is not intended to serve as a substitute for individualized assessment or treatment for children whose needs require a higher level of care.

Some children may benefit from a multidisciplinary feeding team or individualized services from a Registered Dietitian, physician, psychologist, occupational therapist, speech-language pathologist, or other qualified professional.

Participation in the Nourished Village does not guarantee that the Membership is appropriate for your child's individual circumstances.

We reserve the right to recommend that a Member seek individualized professional support when appropriate.

4. MEMBERSHIP PLANS & FEES

The Nourished Village currently offers the following Membership options:

Monthly Membership: $57 USD per month

Quarterly Membership: $155 USD every 3 months

Bi-Annual Membership: $275 USD every 6 months

The specific Membership price and billing frequency selected by you will be displayed at checkout.

By purchasing a recurring Membership, you authorize Nourished Village Nutrition LLC and its payment processor to charge your selected payment method according to the Membership plan you selected.

Unless otherwise stated at the time of purchase, your Membership will automatically renew at the applicable rate until you cancel.

You are responsible for maintaining accurate and current payment information.

5. AUTOMATIC RENEWAL

By purchasing a recurring Membership, you understand and agree that your Membership will automatically renew at the end of each applicable billing period unless you cancel before the next renewal date.

For example:

• A monthly Membership renews every month.

• A quarterly Membership renews every three months.

• A bi-annual Membership renews every six months.

Your applicable renewal price will be the then-current price for your Membership plan, subject to any pricing terms or notice requirements applicable to your purchase.

You may cancel your Membership at any time in accordance with the cancellation provisions below.

6. CANCELLATION

You may cancel your Membership at any time using the cancellation method provided through your Membership account or by contacting:

Cancellation will prevent future renewal charges.

Cancellation does not provide a refund or credit for the current paid Membership period.

You will retain access to the Membership through the end of the period for which you have already paid, unless your access is terminated earlier due to a violation of these Terms or another circumstance described in this Agreement.

After your paid Membership period ends, your access to the Membership will be discontinued.

7. NO-REFUND POLICY

All Nourished Village Membership purchases are non-refundable.

Due to the digital nature of the Membership and the immediate access provided to courses, resources, educational materials, recordings, and other digital content, no refunds, credits, or prorated refunds will be provided for any reason, except where otherwise required by applicable law.

This includes, but is not limited to:

• Failure to use the Membership

• Failure to attend live calls

• Failure to complete courses

• Failure to participate in challenges

• Cancellation after a renewal has been processed

• Change in personal circumstances

• Change of mind

• Lack of expected results

• Inability to attend a particular live call

By purchasing the Membership, you acknowledge and agree to this no-refund policy.

8. FAILED PAYMENTS

If a Membership payment fails, we may attempt to process the payment again using the payment method associated with your account.

You agree to promptly update your payment information if necessary.

If payment remains unsuccessful, we reserve the right to suspend or terminate your Membership access until payment is received.

9. MEMBERSHIP ACCESS

Your Membership provides you with personal, limited, non-exclusive, non-transferable access to The Nourished Village for the duration of your active and paid Membership.

Membership access includes the content and features made available to Members during your active Membership period.

When your Membership is canceled, expires, or is terminated, you will lose access to the Membership, including the community, courses, resource library, recordings, challenges, and other Membership content.

Unless specifically stated otherwise in writing, you do not receive lifetime access to Membership content.

You are responsible for downloading any materials specifically designated as downloadable for personal use before your Membership ends.

10. PERSONAL USE ONLY

Your Nourished Village Membership is intended for your personal use in supporting your own child or children.

You may not share your Membership account, login credentials, or paid Membership access with another person or family.

You may use educational materials within your own household for the purpose of supporting your child.

You may not:

• Share your login information

• Allow another family to use your Membership

• Copy or distribute Membership materials

• Upload Membership materials to another website, group, or platform

• Share paid resources publicly

• Sell or redistribute Membership materials

• Use Membership materials to create your own course, program, membership, or educational product

• Teach, reproduce, license, or commercially exploit the Nourished Village materials without written permission

11. INTELLECTUAL PROPERTY

All materials provided through The Nourished Village are the property of Nourished Village Nutrition LLC or its licensors unless otherwise stated.

This includes, but is not limited to:

• Courses

• Videos

• Audio recordings

• Worksheets

• Guides

• PDFs

• Templates

• Graphics

• Educational frameworks

• Strategies

• Written content

• Challenges

• Recordings

• Community content

• Logos

• Branding

• Trademarks

• The Beyond Picky Method™

• Other proprietary concepts, terminology, and materials developed by Nourished Village Nutrition LLC

Your purchase of the Membership does not transfer ownership of any intellectual property to you.

You receive a limited, personal, non-exclusive, non-transferable license to use Membership materials for your own personal educational purposes while your Membership is active.

All rights not expressly granted to you are reserved by Nourished Village Nutrition LLC.

12. PROHIBITED USE

You agree not to use the Membership or its materials for any unlawful purpose or any purpose prohibited by these Terms.

You may not:

• Reproduce or distribute Membership content without permission

• Record or redistribute live coaching calls

• Share recordings outside the Membership

• Screenshot or distribute proprietary resources

• Use Membership content to provide paid services to others

• Create derivative products from Membership materials

• Claim ownership of Nourished Village materials

• Share another Member's confidential information

• Harass or threaten another Member

• Use the community to promote competing services or products without permission

• Engage in behavior that disrupts the Membership community

Violation of these provisions may result in immediate suspension or termination of your Membership.

13. COMMUNITY GUIDELINES

The Nourished Village is intended to be a supportive, welcoming, and judgment-free community for parents and caregivers.

Members agree to treat one another with respect and compassion.

You agree not to engage in:

• Bullying

• Harassment

• Threatening behavior

• Racism or discrimination

• Abusive or hateful language

• Personal attacks

• Shaming or criticizing other parents or children

• Deliberately disruptive behavior

• Sharing another Member's private information without permission

We reserve the right to remove content, restrict participation, suspend access, or terminate Membership when a Member engages in behavior that violates these Terms or negatively impacts the safety or wellbeing of the community.

14. CONFIDENTIALITY & PRIVACY

The Nourished Village may involve Members sharing personal information about themselves and their children.

You agree to respect the privacy of other Members.

Information shared within the community—including stories, questions, screenshots, photos, names, health information, feeding histories, or other personal information—should be treated as confidential.

You agree not to copy, screenshot, record, share, or distribute another Member's information outside the Membership without their permission.

However, because The Nourished Village is an online community involving multiple participants, we cannot guarantee that every Member will maintain confidentiality.

Please use discretion when sharing personal information about yourself or your child.

15. LIVE CALLS & RECORDINGS

The Nourished Village may offer live group coaching calls, Q&A sessions, workshops, or other live events.

Some live sessions may be recorded and made available to Members as replays.

By participating in a recorded session, you understand that your name, questions, comments, or other contributions may appear in the recording.

If you do not want your participation included in a recording, please follow the instructions provided for that particular session.

Membership recordings are provided solely for the personal educational use of active Members and may not be copied, downloaded for redistribution, shared, posted publicly, or otherwise distributed outside the Membership.

16. MEMBER CONTRIBUTIONS & TESTIMONIALS

Members may voluntarily submit questions, feedback, comments, stories, photographs, testimonials, or other content within the Membership.

You retain ownership of content that you personally create and submit.

By voluntarily sharing content within the community, you grant Nourished Village Nutrition LLC permission to display that content within the Membership for the purpose of facilitating the community and providing the Membership services.

We will not use your child's identifying information or personal story for public marketing purposes without obtaining appropriate permission.

If we would like to use your testimonial, feedback, story, photograph, or other contribution publicly for marketing or promotional purposes, we will obtain your permission before doing so.

17. NO GUARANTEE OF RESULTS

We are committed to providing high-quality education, resources, and support.

However, we do not guarantee any particular result from participation in The Nourished Village.

Every child is different.

Your child's progress may depend on many factors, including your child's individual needs, developmental stage, temperament, sensory profile, anxiety, medical and feeding history, environment, consistency, and other factors outside of our control.

Examples or testimonials shared by Nourished Village Nutrition represent individual experiences and are not guarantees that you or your child will experience the same or similar results.

18. YOUR RESPONSIBILITY

You acknowledge that you are responsible for decisions regarding your child's care and feeding.

You agree to use your own judgment when implementing strategies discussed within the Membership.

You understand that:

• Not every strategy will be appropriate for every child.

• Feeding progress may be gradual or nonlinear.

• Setbacks may occur.

• Your child's needs may change over time.

• Some children require individualized professional support.

You are responsible for seeking appropriate medical or professional care when necessary.

19. THIRD-PARTY SERVICES & PLATFORMS

The Nourished Village may use third-party platforms to host Membership content, process payments, facilitate community discussions, schedule calls, deliver email communications, or provide other services.

We are not responsible for interruptions, outages, technical failures, or changes to third-party services that are outside of our reasonable control.

Your use of third-party platforms may also be subject to those platforms' own terms and policies.

20. TERMINATION & SUSPENSION

Nourished Village Nutrition LLC reserves the right to suspend or terminate your Membership if you violate these Terms or engage in behavior that is abusive, harmful, threatening, disruptive, or otherwise inappropriate.

This may include violations involving:

• Payment

• Intellectual property

• Confidentiality

• Community conduct

• Account sharing

• Unauthorized distribution of Membership materials

• Harassment or abuse

If your Membership is terminated because of a violation of these Terms, you may lose access immediately and will not be entitled to a refund.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Nourished Village Nutrition LLC, Sarah Derry, and their employees, contractors, representatives, and affiliates shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, or other damages arising from or relating to your participation in or use of The Nourished Village, its content, or third-party services.

This includes damages arising from the use or misuse of information provided through the Membership.

To the fullest extent permitted by law, the maximum cumulative liability of Nourished Village Nutrition LLC arising from your participation in the Membership shall not exceed the total amount you paid for the Membership giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Nourished Village Nutrition LLC, Sarah Derry, and their employees, contractors, representatives, and affiliates from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising out of:

• Your violation of these Terms

• Your misuse of Membership materials

• Your unauthorized sharing or distribution of Membership content

• Your violation of another person's rights

• Your negligent or wrongful conduct

Nourished Village Nutrition LLC will provide reasonable notice of any claim for which indemnification is sought.

23. FORCE MAJEURE

Neither party shall be liable for failure or delay in performing obligations under these Terms, except for payment obligations, when such failure or delay results from circumstances beyond reasonable control, including but not limited to natural disasters, fire, flood, telecommunications failures, electrical outages, internet or network failures, governmental actions, pandemics, epidemics, public health emergencies, acts of God, or other circumstances beyond reasonable control.

24. CHANGES TO THE MEMBERSHIP OR TERMS

We may update, modify, add, or remove Membership content, features, resources, calls, challenges, or other offerings as we continue to develop The Nourished Village.

We may also update these Terms from time to time.

If we make material changes to these Terms, we may provide notice through email, the Membership platform, or another reasonable method.

Your continued participation in the Membership after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.

25. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from or relating to these Terms or your participation in The Nourished Village shall be handled in accordance with applicable South Carolina law.

26. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

27. WAIVER

The failure of Nourished Village Nutrition LLC to enforce any provision of these Terms shall not constitute a waiver of the right to enforce that provision or any other provision in the future.

28. ENTIRE AGREEMENT

These Terms, together with any policies or agreements expressly incorporated into them, constitute the entire agreement between you and Nourished Village Nutrition LLC regarding The Nourished Village.

Any prior statements, representations, or agreements concerning the Membership that are inconsistent with these Terms shall not be binding unless expressly incorporated into these Terms in writing.

29. ELECTRONIC ACCEPTANCE

You agree that electronically accepting these Terms—including checking an agreement box during checkout—constitutes your electronic signature and agreement to these Terms.

You acknowledge that your electronic acceptance has the same legal effect as a handwritten signature to the extent permitted by applicable law.
